Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully. They govern your access to and use of dreamingpipes.com (the “Site”) and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

In these Terms, “Dreaming Pipes,” “we,” “us,” and “our” refer to the operator of dreamingpipes.com.

1. Age Requirement

You must be at least 21 years of age to enter the Site, create an account, or place an order. Federal law prohibits the sale of tobacco products to anyone under 21.

By entering the Site and by placing an order, you represent and warrant that you are at least 21 years old and that you are legally permitted to purchase tobacco products and smoking accessories in your jurisdiction.

We use age verification at checkout and may require additional proof of age before shipping. Deliveries of tobacco products require an adult signature from a recipient 21 or older. We reserve the right to refuse or cancel any order we believe has been placed by a minor, and to report such attempts to the appropriate authorities.

Do not order on behalf of anyone under 21, and do not resell or furnish our products to anyone under 21.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information, including a valid shipping address and contact details.

We may suspend or terminate any account at our discretion, including for suspected fraud, abuse, chargeback misuse, attempted purchases by minors, or violation of these Terms.

3. Products, Descriptions, and Images

We work hard to describe our products accurately, but we do not warrant that product descriptions, specifications, measurements, images, or other content on the Site are complete, accurate, current, or error-free.

Please note in particular:

• Natural variation. Briar, meerschaum, and other natural materials vary in grain, color, and figuring. Photographs are representative and the item you receive may differ in appearance.
• Handmade goods. Artisan and handmade pipes are one-of-a-kind. Minor variation is a characteristic of the product, not a defect.
• Tobacco. Blends may vary between production batches. Moisture content, cut, and appearance can shift with age and storage.
• Availability. Inventory changes constantly. Listing a product on the Site is not a guarantee that it is in stock.

If a product you receive is materially not as described, contact us and we will make it right.

4. Pricing and Order Acceptance

All prices are listed in U.S. dollars and are subject to change at any time without notice.

Despite our best efforts, a small number of products on the Site may occasionally be listed at an incorrect price, or with incorrect availability, due to human or technical error, supplier price changes, or delays in updating our catalog.

Placing an order constitutes an offer to purchase. It does not create a binding contract. Your receipt of an order confirmation, an email acknowledgment, or a payment authorization or charge does not constitute our acceptance of your order. We accept your offer, and a contract of sale is formed, only when we ship the order to you.

We reserve the right, at our sole discretion and at any time before shipment, to:

• refuse, limit, or cancel any order for any reason, in whole or in part;
• limit the quantity of any item purchased per person, per household, or per order;
• correct any error, inaccuracy, or omission on the Site, including pricing and availability, at any time and without prior notice, including after an order has been submitted; and
• cancel any order placed at an incorrect price, whether or not the order has been confirmed and whether or not payment has been authorized or captured.

Where the correct price of an item is higher than the price shown on the Site, we may cancel the order rather than fulfill it at the listed price. If we cancel an order for this reason, we will notify you and issue a full refund of any amount charged to your original payment method. A full refund is your sole and exclusive remedy in this situation.

Orders that appear to be placed in a manner intended to exploit a known or obvious pricing or inventory error, including multiple or high-quantity orders of a mispriced item, may be cancelled in full and the associated account closed.

Promotional pricing, discount codes, and sale prices are valid only for the stated period and cannot be applied retroactively to completed or cancelled orders. We may end or modify any promotion at any time.

5. Payment

Accepted payment methods are shown at checkout. We accept all major credit cards and UnionPay. We do not accept virtual, prepaid, or single-use card numbers.

You represent that you are authorized to use the payment method you provide. We may verify that the billing address matches the cardholder of record and may decline any transaction that fails verification.

If payment is declined, reversed, or otherwise fails after shipment, you remain responsible for the amount owed.

For fraud prevention, we limit the number of different payment methods that may be attempted on a single order. If that limit is exceeded, the order cannot be completed online and you will need to contact us directly.

Chargebacks: If you have a problem with an order, please contact us first — nearly everything is resolved quickly. Filing a chargeback without contacting us may result in your account being closed and future orders declined. We will respond to disputes with our shipping and order records.

6. Taxes

Sales tax: We collect and remit sales tax in the states where we are required to do so. Where we do not collect it, remitting any use tax owed is your responsibility.

Tobacco excise tax: A number of states impose an excise tax on tobacco products sold by remote retailers. This tax is separate from and in addition to any sales or use tax. Where such a tax applies to your shipping destination, it is calculated at checkout and is your responsibility.

Tax rates and rules change frequently. We apply them as required by law at the time of your order, and amounts shown at checkout may differ from previous orders.

7. Shipping and Delivery

Orders are typically dispatched within 7–14 business days. Processing times are estimates, not guarantees.

Title and risk of loss pass to you upon delivery of the package to the carrier. Once a package leaves our facility, delivery timing is controlled by the carrier and is outside our control. Published transit times are carrier estimates and are not guaranteed.

You are responsible for providing a complete and accurate shipping address. We are not responsible for packages delivered to an incorrect address supplied by you, or for packages that are stolen after confirmed delivery.

Adult signature is required on deliveries of tobacco products. If delivery cannot be completed because no eligible adult is available to sign, the package may be returned to us; return shipping and reshipment costs may be charged to you.

Lighters and butane: Under FAA regulations, lighters pre-filled with butane and all butane refills are treated as hazardous materials and must ship by ground. An order containing any such item will ship by ground in its entirety, and expedited shipping is not available for that order.

Backorders: Where we accept a backorder for an item not currently in stock, we will not charge your payment method until the item ships. If we are unable to fulfill a backorder, we will contact you to cancel it or substitute an alternative.

Lost or damaged packages — domestic: If a domestic package arrives damaged, is missing items, or shows as delivered but has not arrived, contact us as soon as possible. Claims on domestic shipments must be made within 45 days of delivery, or within 45 days of the last tracking update where no delivery occurs. We cannot investigate or resolve domestic claims made after that period.

Lost or damaged packages — international: International shipments are handled differently, and the timeframes are longer. Claims on international shipments are governed by our Return/Refund Policy, which sets out the applicable waiting periods, the search request process, the form any refund takes, and annual limits. The 45-day period above does not apply to international shipments.

8. Shipping Restrictions

We ship only where we are legally permitted to do so. Certain products cannot be shipped to certain destinations because of federal, state, or local law.

Restrictions take several forms, and they change frequently:

• States we do not ship tobacco products to. We do not ship tobacco products to Arizona, Arkansas, Hawaii, Michigan, Pennsylvania, South Dakota, Utah, Washington, or Wisconsin. Non-tobacco items such as pipes, lighters, and accessories are not affected.
• Product categories restricted in particular states. Certain states prohibit delivery of specific categories, such as loose or pipe tobacco, flavored tobacco products, small or filtered cigars, or roll-your-own tobacco. By way of example and not limitation, we do not ship roll-your-own tobacco to California.
• Additional delivery requirements. Some states require pre-delivery telephone confirmation, retention of age-verification documents, or adult signature at delivery. These requirements may limit the shipping methods available to you and may prevent delivery to a PO Box.
• Carrier restrictions. Hazardous materials, oversized items, PO Boxes, APO/FPO addresses, and US territories may be limited to particular carriers and services.

If you place an order that we cannot lawfully fulfill to your address, we will cancel the affected items and refund you in full. We are not liable for your inability to receive a product due to restrictions in your jurisdiction.

We do not sell cigarettes or smokeless tobacco.

9. International Orders

We accept orders from many countries outside the United States, subject to the following.

Import legality is your responsibility. You are responsible for knowing whether the products you order may lawfully be imported into your country and in what quantity. We cannot advise on foreign law.

Duties and taxes: Any customs duties, import taxes, tariffs, brokerage fees, or other charges assessed by your country are your responsibility and are not included in the price you pay us.

Customs declarations: All packages are declared accurately at full invoice value. We will not undervalue, mislabel, or misdeclare a shipment under any circumstance, and we cannot honor requests to do so.

Seizure and refusal: We are not responsible for, and will not refund, orders that are seized, confiscated, destroyed, or refused entry by customs or any other authority. We are likewise not responsible for orders abandoned by the recipient or returned for unpaid duties or taxes.

Tracking: Economy international services provide tracking only until the package departs the United States. After that point, tracking updates may stop entirely until delivery. This is a limitation of the service, not an indication of a problem, and it is reflected in the lower cost. Customers who want end-to-end tracking should select an express service at checkout.

Transit times: International delivery, particularly by economy mail, can take considerably longer than domestic delivery and is subject to customs processing delays outside our control.

10. Returns and Refunds

Returns are governed by our Return/Refund Policy, which is incorporated into these Terms by reference. Where these Terms and the Return/Refund Policy conflict, the Return/Refund Policy controls on matters of returns.

11. Health Warning

Tobacco products are not safe and are not a safe alternative to cigarettes. Smoking causes serious disease, including cancer and cardiovascular and pulmonary illness. Tobacco products contain nicotine, which is addictive.

You purchase and use these products at your own risk and assume all risks associated with their use.

12. Acceptable Use

You agree not to use the Site to:

• purchase products for resale without our written authorization;
• purchase products for or on behalf of anyone under 21;
• circumvent quantity limits, purchase limits, or age verification;
• scrape, harvest, or copy Site content by automated means; or
• interfere with the operation or security of the Site.

13. Intellectual Property

All content on the Site — including text, product photography, descriptions, graphics, logos, and the Dreaming Pipes name and marks — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

14. Disclaimer of Warranties

Except as expressly stated in these Terms or required by law, the Site and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Manufacturer warranties, where offered, are provided by the manufacturer and are subject to the manufacturer’s terms.

15. Limitation of Liability

To the fullest extent permitted by law, Dreaming Pipes and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Site or any product purchased from us, whether based in contract, tort, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

In all cases, our total aggregate liability arising out of or relating to any order will not exceed the amount you actually paid us for that order.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Dreaming Pipes and its owners, officers, and employees from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your violation of any law, or your misuse of any product purchased from us.

17. Governing Law and Venue

These Terms and any dispute arising out of them or out of any purchase from us are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any action or proceeding must be brought exclusively in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of those courts.

18. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site. Changes take effect when posted. The Terms in effect at the time you place an order govern that order. Please review these Terms periodically.

19. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.

These Terms, together with our Return/Refund Policy and Privacy Policy, constitute the entire agreement between you and Dreaming Pipes regarding your use of the Site and any purchase from us.
